  16. ======================= LICENSE ============================

  18. [1] OWNERSHIP.  Except to the extent expressly licensed by us, we have and
  19.     reserve the exclusive copyright, trade secret and other rights to the
  20.     Program, and the right to use the Trademarks "Apogee", the Apogee Comet
  21.     "logo", "3D Realms", the 3D Realms logo, "Pinball Wizards", the Pinball
  22.     Wizards logo, "Balls of Steel", "Duke Nukem", and any other characters
  23.     contained within the Game in connection with it.  Except to the extent
  24.     expressly licensed, the Company owns and reserves the exclusive right to
  25.     distribute the Game, and the right to use the Trademarks in connection
  26.     with it.  Its content, layout and format are the property of the Company
  27.     to the extent permitted by law.

  29. [2]  GRANT: The Company grants a non-exclusive, non-transferable, royalty-free
  30.      license to distribute the Game only as follows:
  31.  
  32.  [A] INDIVIDUALS are encouraged to share and give copies of the Game to
  33.      friends, family, coworkers, and members of any not-for-profit
  34.      organization, but only without charge.
  35.  
  36.  [B] These grants are subject to the conditions that no copyright information
  37.      or trademark will be added or removed, and all of the Game's files as
  38.      released by the Company will be included without modification (except for
  39.      "New Levels" as permitted below by this license).

  41. [3]  NEW LEVELS.
  42.  
  43.      "New Levels" are data that modify or substitute for Game data, thus
  44.      modifying or replacing one or more Game levels.  Creating or distributing
  45.      a New Level or a software tool that has no substantial purpose other than
  46.      to contribute to the creation of a New Level infringes rights of the
  47.      Company and is prohibited by law except as permitted by the Company.  THE
  48.      COMPANY PERMITS NEW LEVELS ONLY THAT MEET ALL OF THE FOLLOWING
  49.      CONDITIONS:

  51.  [A] The Level must only work with a RETAIL episode of the Game. It must NOT
  52.      work with this Episode One (shareware episode).
  53.  
  54.  [B] The level must not contain modifications to any COM, EXE, or DLL, or to
  55.      other executable file.
  56.  
  57.  [C] The level must not contain any illegal material, or (without
  58.      appropriate irrevocable licenses) any trademarks, copyright protected
  59.      work, or other property of third parties.
  60.  
  61.  [D] The level must prominently identify at least in every online description
  62.      and with reasonable duration on an opening screen
  63.      (1) the name and email address of the level's creators, and
  64.      (2) the words "THIS LEVEL IS NOT MADE BY OR SUPPORTED BY PINBALL
  65.      WIZARDS".

  67.  [E] The level and any use of it must be offered solely for free (other than
  68.      any incidental online charges).
  69.  
  70.  [F] By distributing or permitting the distribution of any New Level, all
  71.      owners of any trademark, copyright or other right, title or interest
  72.      therein (to the extent different from the Game as originally distributed
  73.      by the Company) grant back to the Company an irrevocable royalty free
  74.      right to distribute the level.
  75.  
  76.  [G] The distributor of any New Level or Level Editor must be authorized to
  77.      distribute the Game itself (either in writing, or by being within a
  78.      category where no writing is needed under this LICENSE.DOC).

  80. [4]  TERM: Unless terminated for cause, grants by the Company under this
  81.      LICENSE.DOC terminate 30 days after receipt of written notice, or such
  82.      longer period as the notice may provide.  Sections [2], [6], and [7]
  83.      survive termination.

  85. [5]  LIMITED WARRANTY AND LIMITATION OF REMEDIES: If the Company provides a
  86.      physically defective copy of the Game, the Company will replace it upon
  87.      prompt submission of the defective one.  THE GAME IS OTHERWISE PROVIDED
  88.      "AS-IS", AND NO WARRANTIES OF ANY KIND (INCLUDING IMPLIED WARRANTIES OF
  89.      MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), EXPRESS OR IMPLIED,
  90.      ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON.  OUR ENTIRE LIABILITY AND
  91.      YOUR EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND UNDER NO CIRCUMSTANCES
  92.      WILL WE PROVIDE ANY OTHER REMEDY FOR DIRECT, INDIRECT, SPECIAL,
  93.      CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING FROM IT,
  94.      INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF WARRANTY
  95.      OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES.

  97. [6]  MISCELLANY

  99.  [A] Since the Company would be irreparably damaged if certain sections were
  100.      not specifically enforced, the Company will be entitled without bond, other
  101.      security or proof of damages, to appropriate equitable remedies with respect
  102.      to breaches of such sections, in addition to such other remedies as the
  103.      Company may have.

  105.  [B] You will indemnify and hold the Company, our partners, affiliates,
  106.      contractors, employees and agents harmless from damage, loss and expense
  107.      arising directly or indirectly from your acts and omissions in copying,
  108.      distributing or modifying the Game or any New Level.
  109.  
  110.  [C] With respect to every matter arising under this, you consent to the
  111.      exclusive jurisdiction and venue of the state and federal courts sitting
  112.      in Dallas, Texas, and to service by certified mail, return receipt
  113.      requested, or as otherwise permitted by law.

  115.  [D] Except as explicitly permitted herein, you will not modify the Game.
  116.      Except to the extent, if any, applicable law may require otherwise, you
  117.      will not decompile, disassemble, or reverse engineer the Game, or use or
  118.      disclose any confidential information that it contains.

  120. This version of the license.doc supercedes any previous versions of said
  121. document relating to the Game.  (This Game specifically, and not other titles
  122. published by the Company.)
